Buying a villa in Bali: investor questions
The questions buyers ask us in the first call, in the order they usually come. Each answer is two to four sentences and a link to the article with the document, the law and the numbers.
Ownership
Can a foreigner buy a villa in Bali?
Yes, but not the land freehold: Hak Milik is closed to foreigners by Article 21 of the UUPA agrarian law. The legal formats are a leasehold (Hak Sewa) in your own name, Hak Pakai for KITAS residents and HGB via a PT PMA company where one can still be registered. How long does a leasehold run, and what then?
The market usually gives 25–30 years plus an 'extension by agreement' — which is zero protection. In the projects DOMA represents the term is built in steps: 29 + 10 + 30 = 69 years; the 10-year extension price is fixed on a scale (+10/20/30% of the initial price), the 30-year one by the KF formula under which the owner is obliged to extend. Can I put the land in a trusted Indonesian's name?
No. A nominee arrangement is void under Art. 26(2) UUPA (Supreme Court precedent 3020 K/Pdt/2014), the money is not refundable, and Bali Perda No. 4/2026 introduced liability for the foreigner, the nominee and intermediaries up to confiscation. Coretax matches 'who paid' against 'whose name' automatically. Should I set up a PT PMA for the villa?
For a new Bali deal in 2026 — usually not: since May OSS no longer registers new PT PMAs under 18 KBLI codes, including real estate 68111 and the accommodation codes. Existing companies keep operating. For one villa — a leasehold in your name and a licensed operator for legal rental; PT PMA remains a tool for portfolios and an investor KITAS. Is a leasehold villa inheritable?
Yes, if the notarial deed contains an heirs clause and the lease does not require the owner's separate consent. Heirs receive the remaining term and the extension rights. How do I sell a leasehold villa?
Through a notarial deed assigning the lease rights for the remaining term. Price drivers: years left and a fixed extension, the villa's condition, income history and clean paperwork (PBG, SLF, licences). How does the deal work?
Choose the unit → legal due diligence (2–4 weeks) → deposit and 7 days to review the contract → signing at the notary (in person or by power of attorney) → first 30% payment and the lease registered in your name within 10 working days → stage payments against acceptance acts → final inspection → handover act after the SLF → handover to management. Which documents must I check?
The land certificate and the BPN extract via the notary, zoning (RDTR, LSD/LP2B) and a KKPR with a commercial KBLI, a PBG with commercial designation and a SIMBG number, an SLF for completed buildings, the developer entity's NIB and KBLI, the contract text and the payment structure. Can I buy without coming to Bali?
Yes: checks, negotiation and signing are done remotely under a notarised power of attorney, documents go by courier, payment by bank transfer. We still recommend a 'trust tour': stay at a delivered villa, see the site and the documents in person before deciding. Is a notary mandatory if the documents are 'clean'?
Yes. Land transactions are executed only by a notary/PPAT, who alone obtains the official BPN extract with encumbrances. A privately signed contract holds only until someone disputes it: the signature can be denied (Art. 1875 Civil Code) and the date does not bind third parties (Art. 1880). How much does due diligence cost and how long does it take?
With an independent Bali lawyer — $1,000–2,500 and 2–4 weeks. For a $139–250k villa that is 0.5–2% of the budget; the cost of a mistake is demolition, delisting or an unenforceable contract. The plot is in a yellow zone — can the villa be rented out?
The colour decides nothing; the KKPR with commercial code KBLI 55193 at those coordinates does. In Ubud's residential zone R3 such a KKPR is issued under conditions (Art. 96 of Perda Bali 2/2023, the ITBX matrix) — DOMA verified it in the field. Money, taxes, costs
How much does a Bali villa cost in 2026?
The island median is $256,000–299,000. Completed villas: Ubud $250,000–500,000, Canggu $400,000–800,000, Seminyak up to $1.2 million (Magnum Estate, 06.2026). What is paid on top of the price?
On the resale market — 6–7% in taxes and fees (notary 0.5–1%, registration ~1%, BPHTB up to 5% on a title transfer). From a VAT-registered developer — up to 16–17% (PPN 11–12%). Due diligence $1,000–2,500, transfer fees 1–3%. A plain individual leasehold triggers no BPHTB. How do stage payments work?
30% on signing (construction starts, lease in your name within 10 working days), 30% after the stage-1 act (foundation), 30% after the stage-2 act (structure), 10% at handover after stage 3 and the SLF. Each instalment only for a stage accepted by act. 'A discount for 100% up front at groundbreaking' is a red flag. How do I transfer the money?
The price is fixed in dollars; under Law UU 7/2011 the payment arrives in rupiah at the contractor's corporate account or the notary's escrow. 2026 routes: direct SWIFT, transit hubs (UAE, Kazakhstan, Hong Kong), USDT into rupiah via a licensed exchanger. Which taxes does the owner pay?
On purchase — BPHTB up to 5% (only on a title transfer) and VAT 11–12% on a new build from a VAT-registered developer. Annually — PBB, IDR 500,000–3,000,000 for an Ubud villa. On rent — 10% for residents (PPh 4(2)) or 20% withholding for non-residents (PPh 26), lower under a treaty; plus the 10% local guest tax. At home — a return with a credit for the Indonesian tax. Does the PMK 90/2025 VAT incentive work for a foreigner?
For a foreigner with a KITAS/KITAP and an NPWP — yes, when buying a completed house or apartment up to IDR 5 billion handed over in 2026: the state bears 100% of VAT on the first IDR 2 billion (up to IDR 220 million). What does it cost to run a villa?
A two-bedroom Ubud villa — $7,500–13,000 a year all-in: staff, electricity and water, pool and garden, insurance, repair reserve, PBB. A three-bedroom rental villa in Canggu — $24,000–26,000. Can a foreigner get a mortgage?
A conventional bank mortgage against a leasehold for a non-resident is practically unavailable in Bali: banks lend against title, which a foreigner does not hold. The working tools are the developer's interest-free stage payments and financing at home against other assets. Details and rare exceptions are in the article. Rental & yield
What yield is realistic?
Gross in strong locations — 10–18%; net — 4–6% if self-managed and 10–15% with a professional operator. The actual for delivered DOMA-partner villas is 12.8% net (Green Harmony: 11.6–18.1% per villa in 2025 at $95,000). 'Guaranteed 20%' is marketing, not a range. What is villa occupancy in Ubud?
Across all Ubud listings — 36.6% at a $113 rate (platforms, August 2026), abandoned listings included. Active villas — 60–65% (DUVI). What is needed to rent out legally?
The package: KKPR and PBG with commercial designation, SLF, NIB with KBLI 55193, NPWPD for the 10% local tax. Since 31.03.2026 platforms delist properties without it, since 1 August from tourism-ministry lists (~1,600 properties in the first wave). For a foreign individual the package is usually provided by a licensed operator. What does a management company charge and do?
15–25% of gross revenue (sometimes 20–30% with marketing) plus operating costs at actuals. In return — listings and pricing, guests and cleaning, staff, minor repairs, licences and taxes, a monthly report and payout. A weak operator is exposed by the absence of itemised reports and of an NIB/NPWPD. More: The management company: your yield's real owner
Nightly or long stay — which earns more?
A hybrid: nightly in high season (July–August, December–January), monthly in low season (February–March, October–November). A long-stay rate equals 12–18 nightly rates, but occupancy is 100% with less wear. Pure strategies lose to the hybrid on annual RevPAR. How do I calculate a villa's income myself?
RevPAR = ADR × occupancy; annual revenue = RevPAR × 365. For a 2BR in Ubud per DUVI: $165 × 63% ≈ $104/night ≈ $38,000 a year market-wide; $144/night ≈ $52,500 for managed villas. Construction & handover
How long does a villa take to build?
A 72 m² two-bedroom villa — 10 months under the construction contract in DOMA projects: stage 1 foundation (with columns and pool shell), stage 2 structure (load-bearing, roof, walls), stage 3 finishing. What if the developer misses the deadline?
A written demand (somasi) with a reasonable period → a claim for the contractual penalty → mediation or court. Wanprestasi (breach) is not force majeure; force majeure applies only to unforeseeable events and only if provided for. How does the villa inspection work?
A final inspection of up to 2 weeks against a checklist: conformity to design and PBG, roof and waterproofing, electrics, water and drainage, pool, finishes, furniture against specification, documents. What warranties come with the villa?
Under the construction contract in DOMA projects: 5 years structure, 2 years utilities, 1 year finishes and equipment, from the BAST date. The contractor issues the warranties; DOMA as agency and coordinator polices their performance — but does not guarantee in its own name. Is there really a construction moratorium in Bali?
There is no island-wide ban. Since 2026 six regencies have suspended new permits for hotels, villas and restaurants in overheated zones; the south was not halted; projects with issued KKPR and PBG are unaffected. Check permit numbers in OSS and SIMBG, not promises to 'sort it during construction'. Locations
Ubud or Canggu — where to buy?
Ubud: land $316/m² versus $793 in Canggu (LandLoom), off-plan entry from $139,000, year-round demand from nomads, retreats and families, less competition per guest. Canggu: higher rates and entry price, traffic and overheating, the south's urban flood risk. We work only in Ubud — and explain why. How far are the sea and the airport?
From Lodtunduh (south Ubud, Mirador): the ocean — Pantai Purnama 24 minutes, Sanur 29, Keramas 28; the airport — 50 minutes via the toll road; Ubud centre — 15 minutes. Can I buy a plot with a rice-terrace view?
With a view — yes, if the plot itself is residential and not in the LSD/LP2B. The cheapest, prettiest plots are almost always green zone: converting them for a villa has been a criminal offence since 2026 (Bali Perda 4/2026, up to 5 years and IDR 1 billion). What climate risks does a location carry?
Per the Bali Net Zero coalition map (09.2026): the south — urban flooding; the highlands — landslides; the north and east — drought and erosion; Gianyar with Ubud — watershed floods, irrigation failures, terrace landslides. What does Ubud offer for daily life?
Within 10–15 minutes of the centre: international clinics with 24-hour care, Ari Canti hospital in Mas, dozens of international schools and kindergartens, coworkings, yoga and gyms, 100+ Mbit fibre. Does buying a villa grant residence?
No. Status is obtained separately: the Second Home Visa (a deposit from ~IDR 2 billion ≈ $125k or property of that value, 5–10 years), the Golden Visa ($350k for 5 years / $700k for 10, or an apartment from $1 million) or an investor KITAS via an existing PT PMA. What is required at entry in 2026?
A passport valid 6+ months, the e-Arrival Card, the electronic customs declaration, the Love Bali levy of IDR 150,000, a visa (visa-free, VOA or e-VOA at IDR 500,000 for 30 days, extendable with biometrics). Can I live in my villa part of the year and rent the rest?
Yes, it is the usual model: block the calendar for your weeks, the operator rents the rest. Note that your weeks in high season cost the most in forgone revenue, and 183+ days makes you an Indonesian tax resident with worldwide income to declare. What is the Mirador project?

How will I follow construction from abroad?
After the first payment the owner portal opens: photos, video, drone flights, documents and acts updated every 2 weeks. Each stage closes with an act you see before paying. Can I speak to people who already bought?

Who should not buy a villa in Bali?
Anyone expecting deposit-like liquidity, counting on residence through the purchase, planning on 'guaranteed 20%', or not prepared for the fact that it is a land lease for a term, not ownership. A villa is the resort-property slice of a portfolio with 10–15% cash flow and a 5+ year horizon; the comparison with Phuket and Dubai is in the blog.
